Notarial deed is a legal document fully prepared by a notary public.
In the form of a notarial deed, it is mandatory to conclude contracts regarding the disposition of real estate of legally incapacitated persons, agreements on statutory maintenance, mortgage contracts, and pledge statements prepared in accordance with the provisions of the Mortgage Law governing out-of-court enforcement procedures, which constitute enforceable instruments.
Particularly, in the form of a notarially certified (solemnized) document, the following are concluded:
1) Contract for the transfer of real estate;
2) Mortgage contract and pledge statement if they do not contain an explicit statement by the obligor that, based on the mortgage or pledge agreement, enforcement can be carried out directly upon maturity of the obligation;
3) Contract establishing real and personal servitudes.
